How FemTech Startups Navigate FDA Clearance

FemTech pulled in $2.6 billion in funding in 2024, up 55% from the year before. And yet the category still only accounts for something like 2% of total healthcare venture capital, which tells you the money isn't the bottleneck. The bottleneck sits downstream: uncleared products can't get into clinical channels, can't get reimbursement codes, can't get the credibility that makes a Series B round easy to close. This piece walks through the classification rules, the three FDA pathways, and what a handful of companies actually did (and occasionally botched) to get through the process. Consider it a map, drawn by people who already tripped over these particular roots so you don't have to.
What FDA classification means in practice and why most FemTech products land in Class II
The FDA sorts devices into three risk tiers. Class I is low risk, mostly just registration paperwork. Class II is moderate risk and needs premarket review. Class III gets the agency's full attention and its slowest process. Simple enough as a chart. Figuring out which bucket your actual product falls into is where things get more difficult, depending on how much runway you have left.
Ask most people where a menstrual cup lands and they'll say Class I, because it's silicone, it's gravity, what could go wrong. It's Class II. Requires 510(k) clearance, same tier as basic pregnancy tests. That surprises nearly everyone outside the regulatory world, and it's exactly the kind of assumption that costs founders months once they discover it after building a go-to-market plan around "wellness product, ship whenever we feel like it."
Most of the genuine innovation in FemTech sits in this Class II tier: fertility trackers running algorithms, connected breast pumps, diagnostic apps that tell you something about your body instead of just logging it. All of it needs 510(k) clearance before it touches the market.
The trickiest concept in the whole system is "intended use," and founders underrate it constantly. The FDA doesn't regulate what your product does. It regulates what you say your product is for. A period tracker marketed as a tool for "monitoring normal physiologic functions" can often skate by without formal authorization. The exact same app, same code, same interface, marketed as a way to identify a fertile window for contraception or conception, suddenly has to prove it's safe and effective. Same product. Different sentence in the App Store description. Completely different regulatory universe.
That gray area is wide, and Proov ran into it directly. The company initially got word that its product qualified as Class I, exempt from premarket review. Then the FDA circled back after launch, because Proov's data analysis started suggesting potential causes of infertility, a different intended use than the one that got the initial green light. New intended use, new conversation, and that conversation ended in a 510(k) requirement nobody had budgeted for.
So classification isn't something you settle at the whiteboard stage and forget about. It shifts with every claim you add, every feature you ship, every algorithm update that changes what the product tells the user about her body. Lock the intended use language early and get regulatory counsel on it before it lands in a pitch deck, because pulling language back out after launch costs a lot more than writing it carefully the first time, as Proov's experience shows.
How the 510(k), De Novo, and PMA pathways differ and when each applies to a FemTech product
Three pathways. Three different questions. Each one testing a different kind of claim.
510(k) asks whether your device is substantially equivalent to something already cleared. About 90% of devices going through FDA premarket review are moderate risk and travel this road, and fewer than 10% of 510(k) submissions actually lean on clinical evidence to get there; most run on bench testing and performance data instead. Clue Birth Control is the textbook case. Natural Cycles had already carved out the contraceptive-app category through the harder De Novo pathway, so Clue's team confirmed publicly that its filing used the faster 510(k) route once that category existed to point back to. No predicate, no 510(k), though. The genuinely new ideas, the ones with nothing to reference, can't use this door at all.
That's De Novo's job: for devices that are Class I or II risk but have no legal predecessor. Heavier lift. The company proposes its own classification, suggests the special controls the FDA should require, and builds the entire evidence case from scratch instead of borrowing someone else's. The payoff is real, though. Win a De Novo and your product becomes the predicate for every 510(k) filer who shows up after you. Natural Cycles got the first De Novo ever granted to a contraceptive app in 2018, and every digital contraceptive since gets to cite that filing instead of starting from zero. De Novo submissions stay rare among AI-enabled software devices, something like 2.9% of reviewed cases according to analysis of FDA software-as-medical-device decisions. Theresa Neil at Femovate puts the practical advice bluntly: if you're going De Novo, don't hire a lawyer whose whole résumé is 510(k) work. It requires a different kind of preparation entirely.
PMA sits at the top, reserved for Class III devices, implants, life-sustaining equipment, anything where controls alone can't guarantee safety. It requires actual clinical studies as valid scientific evidence, not bench testing dressed up. Most FemTech startups won't touch PMA on a first product, but anyone building implantable contraception or cardiac-fetal monitoring hardware needs to plan for it, including the detail that once approved, any meaningful change to the device or its labeling triggers a supplement filing. PMA doesn't leave room for surprises after the fact; iterative hardware companies should plan around that now, not later.
Then there's Breakthrough Device Designation, which isn't a pathway so much as an accelerator bolted onto one of the three above. It's for devices treating or diagnosing life-threatening or seriously debilitating conditions. As of June 2025 the FDA had granted 1,176 of these designations total, 165 in fiscal year 2024 alone. But a JAMA Internal Medicine study found only 12.2% of breakthrough-designated devices actually received authorization between 2016 and 2024. Designation buys a faster conversation with the agency. It does not hand you the clearance itself. Teal Health leaned on this designation for its at-home cervical cancer screening device, and it worked, but the clinical data still had to carry the weight. The evidence gap that stretches FemTech timelines beyond any general MedTech benchmark
Textbook 510(k) timeline: about six months. FemTech founders should plan for 12 to 18 months, sometimes longer, and this isn't the agency dragging its feet for sport. It's structural, and the structure predates most of these companies by decades.
Women of childbearing age were largely excluded from clinical trials before 1990. The FDA didn't establish an Office of Women's Health until 1994, and even that came by congressional mandate rather than the agency's own initiative. Decades of exclusion left the evidence base underneath female-specific devices thinner than it is elsewhere in MedTech. Predicate records are sparser. FDA reviewers themselves sometimes have limited institutional familiarity with the category sitting in front of them.
That last part isn't theoretical. Cindy Belardo, co-founder and CEO of Sunny, the first FDA-cleared menstrual cup and applicator, has talked about reviewers asking her flat out: what is a menstrual cup? How is it different from a tampon? What exactly is an applicator? The submission turned partly into an anatomy lesson, and every hour spent explaining the basics to reviewers is an hour, and a dollar, not spent moving the file forward.
Some companies try to dodge all this by staying in wellness-marketing territory instead of pursuing clearance, tempting given the timelines above. But the line between wellness and medical device gets drawn by intended use claims, not product complexity, and Proov's experience shows exactly what happens when the FDA decides you've crossed it after the fact: a forced pivot mid-market, burning capital and credibility at the worst possible moment.
Extended timelines aren't an inconvenience. They're a capital planning problem. Founders need runway built on the assumption that clearance takes twice as long as general MedTech guidance suggests, because in FemTech specifically, it usually does.
What Natural Cycles and Clue reveal about the predicate advantage in digital health
Natural Cycles' regulatory history reads like a decade-long sequence of deliberate moves, and the order matters more than any single one. De Novo clearance in 2018, first ever for a contraceptive app. A 510(k) in 2021 for Oura Ring integration. Apple Watch integration cleared in 2023. In 2024 the company secured a Predetermined Change Control Plan, a pre-approved framework that lets future hardware integrations skip a chunk of the usual submission grind. Over-the-counter and prescription availability arrived in 2025, and a sixth 510(k) covering a next-generation fertility algorithm followed in 2026.
The original De Novo rested on an efficacy case of 98% effective with perfect use, 93% with typical use, putting it in the same range as the combined pill. That's not a footnote. That's the entire foundation the category got built on.
Here's the part that actually matters for competitive strategy: because Natural Cycles absorbed the cost and risk of the De Novo, Clue Birth Control got to file under 510(k) instead. A Clue spokesperson said as much directly, noting that because the software-application-for-contraception category is already recognized by the FDA, Clue and any future entrant raising similar questions get assessed through the standard 510(k) process. The first mover pays full price to open the door. Everyone after pays a toll to walk through it.
Is that actually a bad trade for the first mover, though? Natural Cycles still owns the brand recognition and clinical credibility of having created the category, something a fast-follower 510(k) can't retroactively claim no matter how quickly it clears. If you're building in a genuinely novel FemTech space with nothing to point back to, the De Novo burden is real, but the downstream position, being the reference point everyone else cites, isn't something a competitor can buy their way into later. The PCCP move deserves its own flag too: designing a change control plan early means the next hardware integration or algorithm update doesn't reset the clearance clock back to zero.
How Bloomlife's pivot from consumer wearable to regulated device illustrates the cost of a late regulatory strategy
Bloomlife launched in 2015 as a direct-to-consumer pregnancy contraction tracker, no regulatory clearance attached, sold like any other wearable gadget marketed straight to consumers. Then the company wanted to claim it could identify preterm birth risk and applied for De Novo authorization. The FDA looked at the existing product, the existing marketing, and essentially said: not like this.
What followed wasn't a tweak. New technology infrastructure built from scratch. A shift away from direct-to-consumer sales toward a provider-facing, enterprise model. A full tech stack rebuild designed around clinical use instead of consumer convenience. An in-house regulatory hire. An ISO certification process stacked on top of all of it. In January 2024, nearly nine years after the original launch, Bloomlife MFM-Pro finally cleared as a prescription-based wearable letting providers measure maternal and fetal heart rate at home or in clinic.
Nine years is a long time to spend course-correcting; that gap between 2015 and 2024 represents capital a regulatory-first strategy might have spent on actual growth instead of rebuilding a company around a claim made too early. It's a pattern that shows up elsewhere too: companies chasing consumer traction first and regulatory legitimacy second often find the FDA wants changes to the product and the business model that erase whatever head start the traction gave them.
How Teal Health used clinical evidence and Breakthrough designation to win authorization for a category-first device
At-home cervical cancer screening had no predicate and no established standard of care for self-collection outside a clinic, which put Teal Health squarely in De Novo territory with all the extra evidentiary lifting that implies. The company built its Breakthrough Device application around a public health case that's hard to argue with: roughly one in four women are behind on cervical cancer screenings.
But the designation only opened the door faster. The clinical evidence is what actually walked through it. Teal ran a trial showing its at-home Teal Wand matched physician-collected sample accuracy, and 94% of women in that trial said they preferred the Teal Wand over the existing standard of care. That preference number did double duty, supporting the clinical argument and the public health argument in the same breath. FDA authorization landed in May 2025, with the Breakthrough designation speeding up the back-and-forth once the clinical data was strong enough to carry the conversation on its own.
Investors noticed before the clearance even landed. Teal raised a $10 million seed round in 2024, bringing total funding to $23 million, in a fundraising climate that wasn't exactly generous to first-time medical device companies. Breakthrough designation isn't a shortcut around evidence, whatever the name implies. It's a mechanism for getting the FDA to move faster once the evidence is already strong and the unmet need is large enough that nobody has to argue about it.
The operational decisions that determine whether a clearance process succeeds or stalls
None of the pathway knowledge above matters much if the execution is sloppy, and this is where founders leave time and money on the table more often than the regulatory theory would suggest.
Use the Pre-Submission program. It lets a company sit down with the FDA before filing anything formal, and the agency commits to a written response within 70 days of the meeting request. Pre-Sub conversations cover predicate selection, clinical study design, and the performance testing the agency will expect to see later. Skip this step and the odds of getting hit with additional information requests, or an outright denial, go up considerably. That kind of rework costs months, and months cost money that was already earmarked for something else.
Match your regulatory counsel to the pathway, not just to the industry. A lawyer who's cleared a dozen 510(k)s for fitness trackers isn't automatically the right person to guide a De Novo filing for a category that doesn't exist yet. Theresa Neil's advice is worth repeating because it's the kind of thing founders usually learn the expensive way, if nobody tells them first: different pathway, different playbook, different hire.
